Terms of Use Agreement

Welcome to the Lionheart Auction Group website (the “Site”). The following Terms of Use (“Terms”) govern your access to and use of the Site and the services offered by Lionheart Auction Group (“we”, “us”, or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
Acceptance of Terms
By accessing the Site and participating in our auctions, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional terms, policies, or guidelines that may be posted on the Site.
Eligibility
To use the Site and participate in any auctions, you must meet the following eligibility criteria:
– You must be at least 18 years of age.
– You must successfully complete our KYC (Know Your Customer) verification, which includes providing valid government-issued ID.
– You must register for an account on the Site.
By using the Site, you represent and warrant that you meet all eligibility requirements.
Account Registration and Verification
To participate in auctions, you must create an account by providing accurate and complete information as prompted. As part of the registration process:
– You must provide valid identification information, including but not limited to a government-issued ID to complete our KYC verification.
– You agree to update your registration information promptly as needed to maintain its accuracy and completeness.
We reserve the right to deny account registration or to suspend or terminate your account if we believe you have violated any of these Terms or if the information provided is inaccurate or incomplete.
How Auctions Work
Auctions conducted on our Site operate as follows:
– Items (referred to as “Lots”) will be displayed with descriptions outlining their features, condition, and reserve prices, if applicable.
– Each auction will specify a start and end time; bids can only be placed during this time frame.
– A reserve price may be set for certain Lots, which is the minimum amount that must be met for the Lot to be sold.
Bidding Rules and Obligations
Bids placed on the Site are binding and cannot be retracted once made. Bidders should bid responsibly.
Bid increments will be established and posted on the auction page.
If you wish to cancel a bid, you must contact us immediately, although bid cancellations are generally not permitted under these Terms.
Buyer’s Premium and Fees
Upon winning a bid, the winning bidder agrees to pay a buyer’s premium of 25% of the final hammer price of the Lot. This fee is added to the final bid amount and constitutes part of the total price payable for the Lot.
Payment Terms and Methods
Payment must be made within 5 business days following the auction’s conclusion. Accepted payment methods include:
– Credit/Debit card
– PayPal
– Wire Transfer
Failure to make timely payment may result in cancellation of the sale and further actions.
Failure to Pay Consequences
If payment is not received within the stated payment window, we reserve the right to cancel the sale and retain any associated fees. Additionally, you may be prohibited from participating in future auctions.
International Buyers and Export Restrictions
We welcome international buyers. However, please be aware that certain items may be subject to export restrictions. You are responsible for confirming whether the Lots you purchase can lawfully be imported into your jurisdiction.
Seller Terms and Representations
Sellers must provide accurate information regarding their Lots and represent that they have the right to sell the Lot. We may, at our discretion, reject any Lot that does not meet our standards.
Prohibited Items and Conduct
The following items and conduct are strictly prohibited:
– Items that are illegal to sell or purchase under applicable laws.
– Any fraudulent or deceptive practices.
– Harassment or abuse of staff or other participants.
Violated terms may result in suspension or termination of your account.
Intellectual Property
All content on the Site, including text, graphics, logos, and images, is the property of Lionheart Auction Group or our content suppliers and is protected by applicable copyright and intellectual property laws. Unauthorized use of any materials without our prior express written consent is prohibited.
Disclaimers and Limitation of Liability
The Site and all services are provided “as is” without warranty of any kind. We disclaim all warranties, express or implied, regarding the Site, services, and all Lots. Our liability is limited to the maximum extent permitted by law.
Dispute Resolution
Any disputes arising from these Terms or your use of the Site shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Florida.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Continued use of the Site constitutes your acceptance of the new Terms.
